Terms of Use

These Terms of Use ("Terms") govern your access to and use of the TapJail mobile application (the "App") provided by Ephesian 28 LLC ("Company," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use TapJail. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. License

Subject to your compliance with these Terms, Ephesian 28 LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes.

You may not:

Copy, modify, or create derivative works of the App.
Reverse engineer, decompile, or disassemble any part of the App.
Rent, lease, sell, sublicense, or transfer the App to any third party.
Remove or alter any proprietary notices or labels on the App.
Use the App for any unlawful purpose or in violation of any applicable law or regulation.

3. Apple App Store Terms

Your use of the App is also subject to Apple's App Store Terms of Service. In the event of any conflict between these Terms and Apple's Terms of Service, Apple's Terms of Service shall govern solely with respect to the App Store relationship. Apple is not a party to these Terms and has no obligation to provide any maintenance or support for the App.

4. Subscriptions and Purchases

TapJail offers a premium subscription ("TapJail Pro") with the following options: Weekly, Monthly, Yearly, and Lifetime. Subscriptions are processed through Apple's App Store and managed by RevenueCat.

Billing: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.
Refunds: All purchases are final. Refund requests must be submitted directly to Apple in accordance with Apple's refund policy. We have no control over Apple's refund decisions.
Price Changes: We reserve the right to change subscription pricing at any time. Price changes will be communicated through the App or App Store listing before taking effect.
Free Tier: Certain features are available without a subscription. We reserve the right to modify or discontinue free-tier features at any time.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. EPHESIAN 28 LLC DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED.

We do not guarantee that TapJail will reduce your screen time, change your behavior, or produce any particular outcome. The App provides a tool — results depend entirely on your individual use and circumstances.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EPHESIAN 28 LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, MEMBERS, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL EPHESIAN 28 LLC'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).

7. Indemnification

You agree to indemnify, defend, and hold harmless Ephesian 28 LLC, its officers, directors, members, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; or (d) any content you submit or transmit through the App.

8. Third-Party Services

The App integrates with third-party services including Apple's ScreenTime / FamilyControls API and RevenueCat. We are not responsible for the availability, accuracy, or practices of any third-party service. Your use of third-party services is governed by those services' own terms and privacy policies.

9. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice, and without liability to you. We may also update these Terms at any time. Continued use of the App after any update constitutes your acceptance of the revised Terms.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App ceases immediately. Sections 5, 6, 7, 11, and 12 survive any termination.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State in which Ephesian 28 LLC is registered, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the App shall be resolved through binding individual arbitration under the rules of the American Arbitration Association. You waive your right to participate in a class action lawsuit or class-wide arbitration.

12. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ephesian 28 LLC regarding the App and supersede all prior agreements.
